The U.S. EB-5 Immigrant Investor Program

Introduction

The U.S. EB-5 Immigrant Investor Program (Employment-Based Fifth Preference) was established by the U.S. Congress in 1990 with the aim of stimulating the U.S. economy and creating job opportunities by attracting investments from foreign investors. Under the new regulations enacted in 2022, investors are required to invest $800,000 (Targeted Employment Area-TEA) or $1.05 million into qualifying commercial projects and create at least 10 jobs. The applicant, their spouse, and their unmarried children under the age of 21 can simultaneously obtain green cards.

Program Advantages

3. After obtaining the green card, applicants can live, work, and study anywhere in the US.

4. Children can enjoy free K-12 public education in the U.S., pay in-state tuition rates for university studies, have higher admission rates, and enjoy greater freedom in choosing majors.

5. After meeting the 5-year residency requirement, applicants may apply to become U.S. citizens and obtain a U.S. passport.

Application Requirements

1. Investment amount: Invest $800,000 in a U.S. government-approved commercial project.

2. Source of funds must be legitimate and legal.

3. No communicable diseases.

4. No criminal record.

Application Process

1. Sign a service agreement and prepare documentation.

2. Develop a source of funds plan and complete the investment.

3. Submit the I-526E petition.

4. After the I-526E is approved, apply for a conditional green card:

- If in the U.S., concurrently or subsequently file Form I-485; upon approval, receive a conditional green card.

- If outside the U.S., attend an interview at the National Visa Center (NVC) to obtain an immigrant visa; upon entry to the U.S., receive a conditional green card.

5. Within 3 months before the conditional green card expires, Form I-829 to remove conditions.

6. After the I-829 is approved, obtain a permanent green card.
